Terms of Service ("Terms")

Please read these Terms of Service ("Terms") carefully before using the application "Imagin8" ("Mobile App") or related services, including support services, web applications, or services made available through third-party platforms or social-network services (collectively, the "Services"), operated by WNDR11 LTD ("WNDR11", "us", "we", or "our").

WNDR11 LTD is located at Akropoleos, 59 - 61, 3rd floor, Office 301, 2012, Nicosia, Cyprus, company registration number HE411801.

Your access to and use of the Services is conditioned on your acceptance of these Terms. If you disagree with any part of these Terms, you may not access or use the Services.

Our Privacy Policy explains how Personal Data is collected, used, stored, and shared and forms an important part of these Terms.

1. Use of the Services

The Services are provided for personal and lawful use. You agree to use the Services in accordance with these Terms and applicable laws and regulations.

The Services may be offered free of charge, through subscriptions, one-time payments, or other lawful pricing structures. Features, pricing, availability, and functionality may change from time to time.

2. User Content

The Services may allow you to submit, upload, create, or generate content, including text, photographs, images, graphics, audio, video, and other materials ("User Content").

You retain your rights in User Content to the extent provided by applicable law. By submitting User Content, you grant WNDR11 a limited, non-exclusive, worldwide, royalty-free license to host, transmit, reproduce, modify as technically necessary, and process that User Content solely to provide, secure, maintain, and improve the feature or Service you requested, including processing through authorized service providers.

This license ends when the relevant User Content is deleted from our systems, except to the extent retention is required by law, necessary for security or dispute resolution, or the content has already been processed by a third-party service provider under its applicable retention policies.

You are responsible for ensuring that you have the rights, permissions, and consents necessary to submit User Content. If a photograph contains another person, you should have any permission required by applicable law before submitting it for processing.

3. Photos and Face Data

Certain features allow you to submit photographs that may contain your face or the faces of other people. The visual information in the photograph may be processed to provide the requested feature.

We do not ask you to provide a separate facial scan and do not intentionally create or maintain a separate database of facial biometric identifiers, face templates, or face embeddings from photographs as part of this feature.

Further details concerning collection, use, sharing, storage, retention, and deletion of photographs and face-related information are provided in Section 2 and Sections 4-5 of our Privacy Policy.

4. AI-Powered Features

Certain features of the Services use artificial intelligence provided through third-party services, including the OpenAI API.

When you choose to use an AI-powered feature that requires a photograph, the photograph may be temporarily uploaded to our AWS infrastructure and transmitted from our backend to OpenAI for processing.

Separate permission: Before a photograph is transmitted to a third-party AI service, the Mobile App provides a feature-specific disclosure explaining what data will be sent, identifying OpenAI as the recipient, and explaining that the transfer is required to provide the requested AI feature. Where required, you must choose to continue before the transfer occurs. Acceptance of these Terms alone does not replace the feature-specific permission.

AI-generated results may contain errors, inaccuracies, unexpected results, or content that is not suitable for every purpose. You are responsible for reviewing and deciding whether an AI-generated result is appropriate before relying on it.

AI features may not be available at all times and may be modified, suspended, or discontinued for technical, legal, security, or operational reasons.

5. Temporary Processing and Storage of Photos

Photos submitted for AI-powered features may be temporarily stored in Amazon Web Services (AWS) S3 while a processing request is being completed. WNDR11 intends to delete the temporary copy from its own storage after processing is completed and does not retain it for advertising, profiling, or unrelated purposes.

OpenAI may retain API inputs and outputs according to its applicable API data-retention policies. OpenAI currently states that, except for certain endpoints and features, API inputs and outputs may be retained for up to 30 days for service operation and abuse monitoring, subject to legal exceptions and applicable service-specific arrangements.

6. Third-Party Services

The Services may use third-party providers for hosting, storage, analytics, authentication, payments, AI processing, diagnostics, customer support, and other infrastructure.

Examples may include Amazon Web Services, OpenAI, Amplitude, Firebase by Google, Facebook / Meta, Adjust, payment providers, email providers, CRM providers, and other operational service providers, depending on the features you use.

Third-party services may have their own terms and privacy policies. WNDR11 is not responsible for third-party services that it does not own or control, except to the extent required by applicable law.

7. Social Features

The Services may include social features, public profiles, message boards, sharing functionality, or integrations with social networks. By using these features, you understand that content you choose to make public may be accessible to other users and that WNDR11 cannot control how third parties may use information that you voluntarily make public.

8. Content and Intellectual Property

The Services contain software, technology, text, widgets, messages, links, emails, music, sounds, graphics, pictures, videos, and other materials ("Content"). The Content and related intellectual property rights are owned by WNDR11 or its licensors, affiliates, and partners, as applicable.

Subject to these Terms, WNDR11 grants you a personal, limited, non-exclusive, revocable, non-transferable, non-sublicensable right to access and use the Services for personal, non-commercial purposes.

Unless expressly authorized by us or permitted by applicable law, you must not copy, distribute, sell, sublicense, reverse engineer, decompile, create derivative works from, commercially exploit, or remove proprietary rights notices from the Services or their Content.

9. User Responsibilities

You are responsible for User Content you submit and for your use of the Services and any generated results. You must not submit content that you do not have the right to use or that violates applicable law or another person's rights.

You must not use the Services for unlawful, fraudulent, abusive, harmful, or unauthorized purposes.

10. Subscriptions, Payments and Purchases

Where applicable, subscriptions, one-time purchases, and other paid features are subject to the pricing, billing, renewal, cancellation, and refund rules presented through the relevant purchasing platform.

Payment information may be processed by the applicable payment provider or platform. WNDR11 may receive limited transaction or subscription information necessary to provide the purchased feature and manage the account.

11. Privacy

Our processing of Personal Data is governed by our Privacy Policy. The Privacy Policy describes the categories of Personal Data collected, the purposes of processing, third-party recipients, international transfers, retention, deletion, and user rights.

12. Warranties and Liability

The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law. We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

We do not guarantee the accuracy, completeness, reliability, or suitability of AI-generated results or other automatically generated content.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability for intentional misconduct or mandatory consumer rights.

13. Termination

We may suspend or terminate access to the Services where reasonably necessary, including for violations of these Terms, security concerns, fraud, abuse, legal requirements, or operational reasons.

You may stop using the Services at any time. Provisions that by their nature should survive termination, including intellectual property, privacy-related obligations, liability, and dispute provisions, will survive to the extent permitted by law.

14. Changes

We may modify the Services and these Terms from time to time. Material changes will be reflected by updating the "Last updated" date and, where appropriate, providing additional notice.

Continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Cyprus, without regard to its conflict of law provisions, except to the extent that mandatory consumer-protection or other applicable laws require otherwise.
